1. Parties
This Rental Agreement is between Fernando Leon, doing business as Coachella Valley Heaters ("CVHeaters"), and the customer named on the booking ("Customer").
2. Payment terms
A non-refundable deposit of 25% of the total order is due at booking to reserve the equipment. The remaining balance is due 7 calendar days before the event date. Bookings made within 7 days of the event must be paid in full at booking. Card processing fees charged by Square (3.3% of the payment plus 30¢ per payment) are included in the total shown for online payments. CVHeaters will not automatically charge the remaining balance. A $100 minimum order applies.
3. Delivery, setup and retrieval
All rentals are delivery-only; equipment may not be picked up or returned by the Customer. Delivery within the Coachella Valley is $49. Setup and teardown is an optional service priced per item; if not selected, equipment is dropped off and picked up only. Customer must provide clear, safe access to the setup area and disclose gate codes, stairs or other access conditions. Additional fees may apply for difficult access, waiting time, or locations outside the Coachella Valley.
4. Cancellations and changes
The deposit is non-refundable. Cancellations made more than 7 days before the event will not owe the remaining balance. Cancellations within 7 days of the event are not refundable. Weather-related or date changes may be accommodated at CVHeaters' discretion, subject to availability.
5. Customer responsibility and damage
From delivery until retrieval, the Customer is responsible for the equipment and must protect it from theft, misuse and damage. The Customer will pay the reasonable repair or replacement cost for equipment that is lost, stolen, or damaged beyond normal wear. Equipment must not be moved off the event site.
6. Patio heater and propane safety
Heaters must stay upright on level ground, at least 3 feet from walls, ceilings, umbrellas, tents, decorations, and anything flammable, and only be used outdoors in well-ventilated areas. Do not move a lit heater, cover it, or leave it unattended around children or pets. Do not refill, disconnect, or tamper with propane tanks. Turn heaters off in high wind. If you smell gas, turn off the heater, move people away, and call CVHeaters; call 911 in an emergency.
7. Assumption of risk and liability
The Customer uses the equipment at their own risk and agrees to follow these safety rules and any instructions given at delivery. To the extent permitted by law, the Customer will hold CVHeaters harmless from claims arising from misuse of the equipment or failure to follow this agreement. Nothing here limits liability that cannot be limited under California law.
8. General
